These Terms of Service ("Terms") govern your use of the TheraPreneur mobile application and related services ("Service"). By using TheraPreneur, you agree to these Terms. Please read them carefully.

1. Service Description
TheraPreneur is an AI-powered wellness companion designed specifically for entrepreneurs and founders. The Service includes:
- Sage: Your AI wellness companion for voice and text therapy-style sessions, emotional reflection, and personal growth support
- Amelia: Your onboarding and support assistant for account setup, billing questions, and product guidance
- Insights Dashboard: Visual analytics showing your emotional patterns, session history, and progress over time
- Session Reports: AI-generated summaries of your therapy sessions with key themes and takeaways
- Planner: Schedule future sessions with specific intentions and goals
The Service uses advanced AI models to analyze voice patterns, detect emotional states, and provide personalized wellness guidance based on evidence-based therapeutic approaches.
2. Not a Medical or Crisis Service
CriticalTheraPreneur is NOT a substitute for professional medical advice, diagnosis, or treatment.
Important limitations:
- TheraPreneur is a wellness companion, not a licensed therapist, psychologist, or medical professional
- The AI cannot diagnose mental health conditions or prescribe treatments
- TheraPreneur is NOT a crisis intervention service
- If you are experiencing a mental health emergency, suicidal thoughts, or are in danger, immediately contact:

While Sage includes safety detection that may recognize crisis language and provide appropriate resources, this is a supportive feature and not a replacement for professional crisis intervention.
3. Eligibility
To use TheraPreneur, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into these Terms
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
TheraPreneur is designed for adult entrepreneurs and professionals. We do not knowingly provide services to minors.
4. Account Registration
Passwordless Authentication
TheraPreneur uses passwordless authentication for enhanced security:
- Magic Link: One-time login links sent to your verified email
- Phone OTP: One-time codes sent via SMS to your verified phone number
- Voice Authentication: Optional biometric voice verification on trusted devices
Account Security
You are responsible for:
- Maintaining the security of your email and phone number
- Not sharing magic links or OTP codes with others
- Notifying us immediately of any unauthorized access
- Keeping your recovery contact information up to date
5. AI Model & Data Processing
AI TransparencyTheraPreneur uses multiple AI systems to provide personalized wellness support:
Voice Analysis (Hume AI)
During voice sessions, your audio is analyzed in real-time to detect:
- Emotional states (anxiety, calm, sadness, joy, etc.)
- Speech patterns (pace, energy, pitch variations)
- Engagement indicators (hesitation, confidence, uncertainty)
Note: Audio is processed in real-time and is NOT permanently stored. Only derived emotional metadata is retained.
Clinical Assessment (ANFIS)
Our Adaptive Neuro-Fuzzy Inference System (ANFIS) analyzes session data to:
- Track therapeutic alliance strength
- Recommend appropriate intervention techniques
- Monitor emotional trends over time
- Personalize Sage's responses to your patterns
Conversation AI (OpenAI)
Sage's conversational responses are powered by OpenAI's language models:
- Conversations are processed via OpenAI's API with data processing agreements in place
- Your data is NOT used to train OpenAI's general models
- Session context is maintained within your account only
Personalization & Learning
TheraPreneur learns your preferences and patterns to provide better support:
- Session summaries and themes are stored to maintain continuity
- Your feedback improves recommendations within YOUR account
- Anonymized, aggregated data may be used to improve the overall service
6. Data Handling & Storage
What We Store
- Account Data: Name, email, phone (encrypted at rest)
- Session Metadata: Date, duration, themes, mood scores
- Session Summaries: AI-generated context summaries (NOT full transcripts)
- Memory Items: Goals, breakthroughs, and patterns you've discussed
- Insights Data: Aggregated emotional trends and progress metrics
What We Do NOT Store
- Raw audio recordings (processed in real-time, then discarded)
- Full conversation transcripts (only summaries are retained)
- Biometric voice prints on our servers (stored locally on your device)
Data Location
Your data is stored on:
- Firebase Firestore: User profiles, session metadata, and memory
- Google Cloud Platform: Backend services and processing
- Your Device: Voice authentication biometrics (local only)
All data centers are located in the United States with SOC 2 Type II certification.
7. Health Data & HIPAA Considerations
Health DataHIPAA Status
TheraPreneur is designed with privacy-first principles aligned with HIPAA standards, however:
- TheraPreneur is a wellness application, not a covered healthcare provider
- We are not a "Business Associate" under HIPAA regulations
- We do not process insurance claims or maintain medical records
HIPAA-Aligned Practices
While not legally required, we implement HIPAA-grade security measures:
- Encryption: AES-256 encryption for all sensitive data at rest
- TLS 1.3: All data in transit uses modern encryption protocols
- Access Controls: Role-based access with audit logging
- Data Minimization: We only collect what's necessary for the service
- User Control: Full data export and deletion capabilities
- Breach Notification: Commitment to notify users of any security incidents
Protected Health Information (PHI)
Your wellness conversations may contain sensitive health information. We treat this data with the same care as PHI:
- Encrypted storage with limited access
- No sharing with third parties for marketing
- No sale of personal health data
- Strict employee access controls

- Backups: Encrypted with separate key management
Authentication Security
- Firebase Authentication with secure token management
- Magic links expire after 15 minutes
- OTP codes expire after 10 minutes
- Device trust tracking with anomaly detection
- Automatic session expiration after inactivity
Infrastructure Security
- Google Cloud Platform with SOC 2 Type II certification
- Firebase with Google's enterprise security
- Regular security audits and penetration testing
- 24/7 monitoring and intrusion detection
- Automated vulnerability scanning
Voice Session Security
- WebSocket connections secured with TLS
- Audio streams encrypted end-to-end
- No permanent audio storage
- Real-time processing with immediate disposal
9. User Responsibilities
When using TheraPreneur, you agree to:
- Use the Service only for personal wellness purposes
- Provide accurate information during sessions
- Not attempt to reverse-engineer or exploit the AI systems
- Not use the Service to harm yourself or others
- Not share your account access with others
- Seek professional help for serious mental health concerns
- Report any bugs or security vulnerabilities responsibly
10. Intellectual Property
Our Property
TheraPreneur, including the Sage and Amelia AI personalities, user interface, and underlying technology, is owned by TheraPreneur and protected by intellectual property laws.
Your Content
You retain ownership of the content you share during sessions. By using the Service, you grant us a limited license to:
- Process your content to provide the Service
- Generate summaries and insights for your use
- Use anonymized, aggregated data to improve the Service
11. Subscriptions & Payments
Plans
- Explorer (Free): 30 minutes welcome voice time, unlimited text
- Thrive ($9.99/month or $99.99/year): 60 minutes voice time per month, priority features, expanded memory
Voice Time
- Voice minutes are consumed during active voice sessions with Sage
- Unused Thrive minutes do not roll over to the next month
- Additional voice time can be purchased separately
Billing
- Subscriptions are billed in advance
- You can cancel anytime; access continues until the end of the billing period
- Refunds are handled on a case-by-case basis
12. Termination
By You
You may delete your account at any time through the app settings. Upon deletion:
- Your account enters a 7-day grace period (you can cancel deletion)
- After the grace period, personal data is permanently deleted within 30 days
- Some anonymized, aggregated data may be retained for analytics
By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in abusive or harmful behavior
- Attempt to exploit or compromise the Service
13. Disclaimers & Limitations
Service Provided "As Is"
TheraPreneur is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- Specific therapeutic outcomes
- Accuracy of AI-generated insights or recommendations
Limitation of Liability
To the maximum extent permitted by law, TheraPreneur shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data or business interruption
- Actions taken based on AI recommendations
- Mental health outcomes or crises
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms in the app
- Sending a notification to your registered email
- Displaying a notice when you next use the Service
Continued use after changes constitutes acceptance of the new Terms.
